Note: The site plan submittal does not identify, nor does City Engineering have information pertaining to a recorded easement for the existing circa 1938 Town of Madison constructed, now City of Madison owned, public sanitary sewer on this property. There may be an easement of record that simply has not been found of record with the Dane County Register of Deeds, or it is possible one was never recorded. It would be preferred to have the property owner grant an easement to the City over these existing facilities, yet an easement by prescription based on existence for over 70 years is implied.

Note: The Zoning Board of Appeals on March 19, 2009 approved a waterfront variance and a right and left side yard area exceptions as per the plans submitted.
