Engineering Mapping 

Note: Supplementary Condition Completed (was The Applicant shall submit, prior to plan sign-off, a digital CAD file (single file) to the Engineering Program Specialist in the Engineering Division (Lori Zenchenko). The digital CAD file shall be to scale and represent the final approved plan and construction. The single CAD file submittal can be either AutoCAD (dwg) Version 2001 or older, MicroStation (dgn) Version J or older, or Universal (dxf) format and contain the only the following data, each on a separate layer name/level number: a) Building Footprints; b) Internal Walkway Areas; c) Internal Site Parking Areas; d) Other Miscellaneous Impervious Areas (i.e. gravel, crushed stone, bituminous/asphalt, concrete, etc.); e) Right-of-Way lines (public and private); f) All Underlying Lot lines or parcel lines if unplatted; g) Lot numbers or the words “unplatted”; h) Lot/Plat dimensions; i) Street names. All other levels (contours, elevations, etc) are not to be included with this file submittal. NOTE: Email file transmissions preferred Lzenchenko@cityofmadison.com . Include the site address in the subject line of this transmittal. Any changes or additions to the location of the building, sidewalks, parking/pavement during construction will require a new CAD file.)

Lighting 

Note: The building lights were not shown on the photometric plot and must be reviewed before installation.

Planning 

Note: The final plans generally conform to the plans approved by the Plan Commission.

Note: The applicant has responded to condition #32a, which requested the shutters shown on the northern and southern elevations to have vision glass behind them where not located in a restroom, office or kitchen. The shutters were to be operable with vision glass beyond to allow natural lighting into the restaurant. The applicant responded that all but one of the shutters shown would be in a restroom, office or kitchen and that the last set of shutters would be in a bar area, where having a window would create an undue burden on the operation of the restaurant. Based on the July 1, 2009 letter from the applicant, Planning staff will accept the elevations as submitted with the inoperable/ decorative shutters as shown.

Note: Supplementary Condition Completed (was The final plan set approved for permits by Zoning shall contain all of the plan set pages, including the final detailed elevations and floorplans in addition to the site and civil materials in the resubmittal packet. All of the plans in the final plan set shall match the plans approved by the Plan Commission and Urban Design Commission.)

Real Estate 

Note: The existing Right of Entry Agreement will serve as the interim agreement to cover the City's right to repair, operate, and maintain the existing traffic signal facilities in the West Towne Mall Road that junctions with South Gammon Road opposite the intersection of South Gammon Road with Gammon Place.

Traffic Engineering 

Note: After further review with the City Attorney’s office regarding the need for a limited easement on the driveway entrance at the Gammon Road-Gammon Place intersection, it appears that that the existing Right-of-Entry provides sufficient access to permit City of Madison crews to operate and maintain the Traffic Signal at this intersection, including within the Right of Entry area. Therefore, Traffic Engineering agrees to remove the requirement that CBL grant this easement as a condition of approval.

Zoning 

Note: Signage approvals are not granted by the Plan Commission. Signage must be reviewed for compliance with Chapter 31, MGO Street Graphics Code and Chapter 33.24 Urban Design Commission ordinances. Signage permits are issued by the Zoning Section of the Department of Planning and Community and Economic Development.
